Terms and Conditions

These terms govern the use of Eventium by organizers, attendees, and any visitor. By creating an account or buying a ticket you accept these terms in full.
If you disagree with any part, please do not use the service.
1. What Eventium is
Eventium is a technology intermediary that gives organizers tools to sell tickets, manage their events, and communicate with attendees. Eventium does not organize events, does not produce them, does not control their content, and is not a party to the main contract between attendee and organizer.
The Organizer is responsible for dates, location, content, entry policy, cancellations, refunds beyond those required by law, and any incident during the event.
2. User account
To buy tickets or create events you must register an account with accurate data and keep it up to date. You are responsible for keeping your password confidential and for the activity that happens under your account.
Eventium may suspend or close accounts that breach these terms, use the service fraudulently, or put the platform at risk.
3. Fees and payments
Eventium charges a variable commission on each ticket sold through the platform, calculated as a percentage of the ticket price following the tiered rates published on the platform landing page and the Organizer's dashboard. Tickets priced below the per-currency minimum threshold are subject to an internal minimum fee covering processing costs; the final figure is itemized for the Organizer before the event is published and on every invoice.
The Service Commission is deducted from the gross sale amount before the final transfer to the Organizer. Eventium never transfers the gross amount and bills the commission afterwards: the net figure shown in the dashboard is always the amount the Organizer will receive in their bank account, once legal deductions and any withholdings contemplated in these terms have been applied.
Commissions charged for the platform management service are non-refundable even if the event is cancelled, unless applicable law requires otherwise. Eventium will use reasonable efforts to help the Organizer refund attendees when an event is cancelled for reasons attributable to the Organizer.
Payments are processed through Stripe. Eventium does not store full card details.
Eventium operates one Organizer settlement rail: "Eventium Settlements", where Eventium acts as temporary custodian of the funds and pays the Organizer as described in clause 4 below.
For transfers outside the Single Euro Payments Area (SEPA), correspondent bank fees and currency conversion charges may apply. Those costs are borne by the Organizer and will be deducted from the amount transferred, with the breakdown provided in the settlement statement.
Minimum settlement amount: 100 € (or its equivalent in the event's currency). Smaller amounts accumulate in the available balance and roll into the next settlement that exceeds the threshold, preventing bank fees that would be disproportionate to the transfer.
Legal data required to settle: registered business name, VAT / Tax ID (without country prefix), registered address, postal code, city, legal-entity country, and IBAN or equivalent bank routing details. While any of those fields is missing, the Organizer's balance accumulates but no settlement is executed. Keeping this data up to date through the account panel is the Organizer's responsibility.
4. Custody of funds, settlement timing and withholding
Under "Eventium Settlements", Eventium acts as a temporary custodian of the funds collected on the Organizer's behalf. Those funds are tracked and segregated on Eventium's ledger and do not form part of Eventium's freely disposable assets.
Settlement cadence: every Tuesday, Eventium runs an automatic settlement that includes all events closed up to the previous Sunday, with no manual request from the Organizer. The bank transfer is initiated on Tuesday and typically lands in the Organizer's account 1–3 business days later. Events whose balance is below the 100 € minimum, or whose Organizer's legal or banking data is incomplete, roll into the next eligible Tuesday batch.
The weekly payout is contingent on the verification that: (i) the event took place on the announced date, location, and conditions; (ii) no open payment disputes or refund requests exist in an anomalous proportion; and (iii) there is no reasonable suspicion of fraud or material incidents reported by attendees. For exceptional needs (high-volume events, operational urgency, change of recipient account), the Organizer can contact their account manager or email eventium.business@gmail.com at least 48 hours before the relevant Tuesday.
Eventium reserves the right to withhold funds, in whole or in part, in any of the following situations: (a) an unusual volume of refund requests, reversals, or chargebacks that exceeds industry-standard thresholds; (b) a reasonable suspicion of fraud, money laundering, or breach of these terms; (c) inability to verify that the event was held; (d) pending attendee claims reasonably supported by evidence; or (e) a request from a competent authority.
Withheld funds may be used first to reimburse affected buyers before any settlement to the Organizer. The withholding is temporary and will be lifted once the situation is resolved, at Eventium's reasoned discretion or as required by the competent authority. Eventium will inform the Organizer of the cause of the withholding and, where possible, the estimated resolution timeframe.
Eventium may cancel a pending manual payout request for justified reasons (incorrect bank details, suspected fraud, event incidents, or regulatory requirements). In that case the Organizer will be notified of the reason, the amount will be released back to the available balance, and a new request may be submitted once the underlying cause is resolved.
Clawback for post-settlement refunds: if any ticket included in a settlement is later refunded to the buyer, in whole or in part, the Organizer's share will be automatically deducted from the next settlement via an offsetting ledger entry shown in the payout history. When the available balance is insufficient to absorb the deduction, the outstanding amount will roll over into subsequent settlements, and Eventium may request repayment from the Organizer where legally applicable.
5. Organizer's bank details
The Organizer is solely responsible for the accuracy, completeness, and validity of the bank details provided to Eventium (IBAN, account holder name, SWIFT/BIC where applicable, tax identification number, and any other information required for settlement).
Eventium shall not be liable for transfers that fail, are delayed, or are sent to the wrong account where the cause is incorrect, incomplete, or outdated bank details provided by the Organizer.
If a bank rejects or reverses a transfer due to incorrect details, any bank charges arising from the return and the re-issue will be borne by the Organizer and may be deducted from the amount to be settled.
Eventium may suspend settlements until the Organizer corrects and validates their bank details. Such suspension, where it originates in incorrect data supplied by the Organizer, shall not give rise to interest, compensation, or any liability on Eventium's part.
6. Tickets and event access
Each ticket contains a unique identifier that must be presented at the entrance. Tickets are personal and non-transferable unless the organizer expressly permits transfer.
Courtesy tickets (invitations issued by the organizer) cannot be resold under any circumstance. Reselling an invitation results in the immediate cancellation of the ticket without any right to compensation.
The organizer may set additional access requirements (age, dress code, ID). If you fail to meet them you may be denied entry without refund.
7. Organizer responsibility
The Organizer is solely responsible for: the accuracy of the event information, compliance with applicable regulations, mandatory insurance, safety and capacity, tax and labor obligations, the protection of personal data received through the platform, and resolving any incidents with attendees.
The Organizer will indemnify Eventium against any claim arising from the content or execution of the event.
8. Prohibited conduct
Do not use Eventium for illegal activities, selling counterfeit tickets, reverse engineering the platform, bypassing access or security controls, spamming attendees, or any use that infringes third-party rights.
9. Limitation of liability
Eventium provides the platform "as is". To the maximum extent permitted by applicable law, we are not liable for lost profits, reputational harm, or indirect damages arising from the use of the service. Our total liability to any user is limited to the commissions paid in the six months prior to the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot be excluded by law (e.g. for fraud, gross negligence, death, or personal injury).
10. Governing law and jurisdiction
For users in Spain and the EU, these terms are governed by Spanish law, without prejudice to the mandatory consumer rights of your country of residence, and the Spanish courts are competent.
For users in the United Kingdom, the law of England and Wales applies and the courts of England and Wales are competent.
For users in Australia, the law of the State or Territory of the user's residence applies, without prejudice to the Competition and Consumer Act 2010 and the Australian Consumer Law.
For users in the United States, including California, these terms are governed by the laws of the State of Delaware. Any dispute will be resolved by binding individual arbitration administered by JAMS under its consumer rules, seated in San Francisco, California. You waive the right to a jury trial and to participate in class actions. You may opt out of arbitration by notifying us in writing within 30 days of accepting these terms.
11. Changes to these terms
Eventium may update these terms. The new version will be posted here with the relevant date. Material changes will be notified to registered users at least 15 days in advance where reasonably practicable.
